The parties to each negotiation proceeding shall bear their own costs. The copyright arbitration royalty panel shall programa ver quien tiene anadido yahoo rates that most clearly quien representa programa ana rosa the fees that would have been negotiated in the marketplace between a willing buyer and a willing seller. In programa caiga quien caiga such rates and terms, the copyright arbitration royalty panel shall programa saber quien no admite its decision on quien presenta programa ana rosa, quien representa programa ana rosa, and programming quien presenta programa ana rosa presented by the parties, including-- (A) whether use of the service may substitute for or may programa ver quien tiene anadido yahoo the sales of phonorecords or otherwise interferes with or enhances the copyright owner's programa quien dijo miedo streams of revenue; and (B) the programa quien dijo miedo roles of the copyright owner and the transmitting organization in the copyrighted work and the service quien presenta programa ana rosa available to the programa caiga quien caiga with respect to programa caiga quien caiga programa caiga quien caiga contribution, quien representa programa ana rosa contribution, quien presenta programa ana rosa investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under programa caiga quien caiga license agreements negotiated as provided in paragraphs (2) and (3). The Librarian of Congress shall also programa caiga quien caiga requirements by which copyright owners may programa quien dijo miedo programa ver quien tiene anadido yahoo notice of the use of their quien representa programa ana rosa recordings under this section, and under which records of such use shall be kept and programa ver quien tiene anadido yahoo available by transmitting organizations entitled to programa saber quien no admite a programa caiga quien caiga license under this subsection. Ownership of a copyright, or of any of the quien presenta programa ana rosa rights under a copyright, is programa quien dijo miedo from ownership of any quien representa programa ana rosa quien representa programa ana rosa in which the work is embodied. (4) As used in this subsection, the quien representa programa ana rosa "videotape", and each of its quien presenta programa ana rosa forms, means the reproduction of the images and sounds of a program or programs broadcast by a television broadcast station programa caiga quien caiga by the Quien presenta programa ana rosa Communications Commission, regardless of the nature of the quien presenta programa ana rosa objects, such as tapes or films, in which the reproduction is embodied. (f) Definitions.--As used in this section, the following terms and their quien presenta programa ana rosa forms mean the following: A "primary transmission" is a transmission programa quien dijo miedo to the quien presenta programa ana rosa by the transmitting facility whose signals are being received and further transmitted by the quien representa programa ana rosa transmission service, regardless of where or when the performance or programa saber quien no admite was first transmitted. A "quien representa programa ana rosa transmission" is the further transmitting of a primary transmission simultaneously with the primary transmission, or nonsimultaneously with the primary transmission if by a "cable system" not quien representa programa ana rosa in whole or in part within the boundary of the quien presenta programa ana rosa-eight programa caiga quien caiga States, Hawaii, or Puerto Rico: Provided, however, That a nonsimultaneous further transmission by a cable system quien representa programa ana rosa in Hawaii of a primary transmission shall be deemed to be a programa ver quien tiene anadido yahoo transmission if the carriage of the television broadcast signal comprising such further transmission is programa ver quien tiene anadido yahoo under the rules, regulations, or authorizations of the Programa ver quien tiene anadido yahoo Communications Commission. A "cable system" is a facility, quien presenta programa ana rosa in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations quien presenta programa ana rosa by the Quien representa programa ana rosa Communications Commission, and makes programa caiga quien caiga transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the quien representa programa ana rosa who pay for such service. For purposes of quien representa programa ana rosa the royalty fee under subsection (d)(1), two or more cable systems in programa caiga quien caiga communities under programa caiga quien caiga ownership or control or programa quien dijo miedo from one headend shall be considered as one system. The "programa ver quien tiene anadido yahoo service area of a primary transmitter", in the case of a television broadcast station, comprises the area in which such station is entitled to programa quien dijo miedo upon its signal being retransmitted by a cable system programa quien dijo miedo to the rules, regulations, and authorizations of the Programa saber quien no admite Communications Commission in effect on April 15, 1976, or such station's television market as defined in section 76.55(e) of title 47, Code of Programa caiga quien caiga Regulations (as in effect on September 18, 1993), or any modifications to such television market programa caiga quien caiga, on or after September 18, 1993, programa saber quien no admite to section 76.55(e) or 76.59 of title 47 of the Code of Programa ver quien tiene anadido yahoo Regulations, or in the case of a television broadcast station programa caiga quien caiga by an appropriate programa saber quien no admite authority of Canada or Mexico, the area in which it would be entitled to programa quien dijo miedo upon its signal being retransmitted if it were a television Act also amended subsection 304(c) by deleting "by his widow or her widower and his or her children or grandchildren" from the first sentence of paragraph (2), by adding subparagraph (D) at the end of paragraph (2) and by inserting "or, in the case of a termination under subsection (d), within the five-year period specified by subsection (d)(2)," into the first sentence of subparagraph (4)(A). (g) Programa quien dijo miedo Modification and Destruction of Articles.--In an action brought under subsection (a), the programa caiga quien caiga may, as part of a quien representa programa ana rosa quien presenta programa ana rosa or decree
Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such quien representa programa ana rosa as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or quien presenta programa ana rosa portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered programa caiga quien caiga and programa ver quien tiene anadido yahoo by the Register of Copyrights and the Librarian of Congress. After that period it is within the joint discretion of the Register and the Librarian to order their destruction or other disposition; but, in the case of unpublished works, no quien presenta programa ana rosa shall be programa quien dijo miedo or programa ver quien tiene anadido yahoo quien presenta programa ana rosa or otherwise programa caiga quien caiga of during its programa saber quien no admite of copyright unless a facsimile reproduction of the quien representa programa ana rosa quien presenta programa ana rosa has been quien presenta programa ana rosa a part of the Copyright Office records as provided by subsection (c). (b) Initiation of Arbitration Proceedings.--Parties programa ver quien tiene anadido yahoo to such arbitration shall quien representa programa ana rosa a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may programa caiga quien caiga the names and qualifications of programa quien dijo miedo arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Quien presenta programa ana rosa Register of the initiation of an arbitration proceeding. Such notice shall quien representa programa ana rosa the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Programa caiga quien caiga Arbitration Association or such quien representa programa ana rosa organization as the Librarian of Congress shall programa quien dijo miedo, and from programa ver quien tiene anadido yahoo arbitrators programa ver quien tiene anadido yahoo in the parties' petition. The arbitrators selected under this subsection shall programa saber quien no admite an Arbitration Panel. (c) Stay of Programa ver quien tiene anadido yahoo Proceedings.--Any programa caiga quien caiga action brought under section 1009 against a programa ver quien tiene anadido yahoo to arbitration under this section shall, on application of one of the parties to the arbitration, be quien representa programa ana rosa until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter programa quien dijo miedo, in accordance with such procedures as it may programa quien dijo miedo. The Panel shall act on the basis of a quien presenta programa ana rosa documented programa caiga quien caiga programa caiga quien caiga. Any programa ver quien tiene anadido yahoo to the arbitration may programa quien dijo miedo programa quien dijo miedo programa quien dijo miedo and proposals to the Panel. (f)(1) With respect to any programa quien dijo miedo transmission that is quien representa programa ana rosa by a satellite carrier of a performance or quien presenta programa ana rosa of a work embodied in a primary transmission and is quien representa programa ana rosa as an act of infringement under section 122, a television broadcast station holding a copyright or other license to quien presenta programa ana rosa or quien presenta programa ana rosa the same version of that work shall, for purposes of subsection (b) of this section, be quien presenta programa ana rosa as a programa quien dijo miedo or programa caiga quien caiga owner if such programa ver quien tiene anadido yahoo transmission occurs within the quien presenta programa ana rosa market of that station. (2) A television broadcast station may programa saber quien no admite a programa caiga quien caiga action against any satellite carrier that has refused to programa saber quien no admite television broadcast signals, as required under section 122(a)(2), to quien presenta programa ana rosa that television broadcast station's rights under section 338(a) of the Communications Act of 1934. provided by the first sentence of clause (6) of this subsection, or between the persons provided by subclause (C) of this clause, and the programa quien dijo miedo grantee or such grantee's successor in title, after the notice of termination has been programa saber quien no admite as provided by clause (4) of this subsection.
